1. Overview

Supezcar is an online store operated by Nestrient LLC ("Supezcar," "we," "us," or "our"), a limited liability company organized under the laws of the State of Colorado, United States.

We respect the intellectual property rights of others and expect our customers to do the same. This policy explains how to notify us if you believe material on supezcar.com (the "Site") infringes your copyright, how we respond, and how to dispute a removal.

It is written to follow the notice-and-takedown procedure in the Digital Millennium Copyright Act, 17 U.S.C. § 512.

2. What This Policy Covers

The Site contains two kinds of material:

  • Content we publish ourselves — product photography, descriptions, page text, graphics, and the Supezcar name and logo

  • Content submitted by customers — product reviews, and photographs customers send us or post alongside a review

This policy applies to both. If you believe either infringes a copyright you own or are authorized to represent, tell us and we will act.

3. How to Send Us a Copyright Infringement Notice

Email support@supezcar.com with the subject line "DMCA Notice."

To be effective under 17 U.S.C. § 512(c)(3), your notice must include all six of the following. A notice missing any of them may delay our response, and we may ask you to resubmit.

  1. Your signature — physical or electronic — as the owner of the exclusive right allegedly infringed, or as a person authorized to act on the owner's behalf.

  2. Identification of the copyrighted work you claim has been infringed. If several works on the Site are covered by one notice, a representative list of those works.

  3. Identification of the material you say is infringing, with enough detail for us to find it. Please give us the full URL of the page, and describe exactly which image, paragraph, or element is at issue. "Somewhere on your site" is not enough for us to act on.

  4. Your contact information — mailing address, telephone number, and email address.

  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

We acknowledge every properly submitted notice within 1 business day.

4. Designated Copyright Agent

Email is the fastest route and the one we monitor most closely. Mailed notices are accepted but will take longer to reach us.

5. What We Do When We Receive a Notice

  1. We review it. We check that the notice contains the six elements in Section 3 and that the material is actually on our Site.

  2. We act expeditiously. Where the notice is valid, we remove or disable access to the material.

  3. We tell the person who posted it, if the material was submitted by a customer, and we send them a copy of your notice so they can respond.

  4. We explain their options, including the counter-notification process in Section 6.

  5. We keep a record of the notice, our decision, and what we did.

Removing material is not an admission that infringement occurred. It is the process the statute sets out, and we follow it.

6. Counter-Notification

If your content was removed and you believe that happened by mistake or because the material was misidentified, you may send a counter-notification.

Email support@supezcar.com with the subject line "DMCA Counter-Notice." Under 17 U.S.C. § 512(g)(3) it must include:

  1. Your signature — physical or electronic.

  2. Identification of the material that was removed, and the location where it appeared before removal.

  3. A statement, made under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.

  4. Your name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside the United States, any judicial district in which Nestrient LLC may be found — and that you will accept service of process from the person who filed the original notice, or from that person's agent.

What happens next

We forward your counter-notification to the person who sent the original notice, along with a statement that we will restore the material in 10 to 14 business days.

We restore it within that window unless our designated agent first receives notice that the original complainant has filed a court action seeking to restrain you from the activity in question. If we receive that notice, the material stays down.

7. Repeat Infringer Policy

Nestrient LLC has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers.

In practice this means we track valid notices against a customer's account, and where a pattern emerges we may remove that customer's ability to submit reviews or photographs, close their account, or decline to accept further orders. We consider the number of notices, whether any were successfully countered, and the seriousness of the conduct before we act.

8. False or Abusive Claims

Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing — or that material was removed by mistake — may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, or by us.

Please be certain of your rights before you send a notice. The DMCA process is not a way to remove a negative review, resolve a competitive dispute, or take down content you simply dislike. We will decline notices that are plainly being used for those purposes.

If you are unsure whether you hold the rights you believe you hold, speak to an attorney first.

9. Trademark and Other Intellectual Property Complaints

The DMCA covers copyright only. It does not apply to trademarks, patents, trade dress, publicity rights, or defamation.

If you believe the Site infringes a trademark or another right that is not a copyright, email support@supezcar.com with the subject line "Trademark Complaint." Please include:

  • The mark or right at issue, and your registration number if you have one

  • Evidence that you own it or are authorized to act for the owner

  • The full URL and a description of exactly what you say is infringing

  • Your contact details

We review these on the same timeline and will respond in writing.

Vehicle manufacturer trademarks

Vehicle make and model names appear on the Site solely to identify which of our products fits which vehicle. Supezcar is not affiliated with, endorsed by, or sponsored by any vehicle manufacturer. No vehicle manufacturer has reviewed, approved, or certified our products. All vehicle names and marks belong to their respective owners.

10. If You Believe We Infringed Your Work

We would rather fix a problem than argue about one. If a photograph, description, or graphic on our Site is yours and we are using it without permission, tell us at support@supezcar.com with the subject line "DMCA Notice" and we will investigate promptly.

If we sourced the material from a supplier who represented that they held the rights, we will still remove it while we sort out the position with that supplier. Your notice is not a dispute we make you win first.

11. Our Own Content

The text, product photography, graphics, layout, and the Supezcar name and logo on this Site are owned by Nestrient LLC or licensed to us, and are protected by U.S. copyright and trademark law. Section 13 of our Terms of Service sets out what you may and may not do with them.
